Biance Cheah: DPP deciding whether to pursue fraud case

The fraud case against Sydney lifestyle influencer Bianca Cheah has been referred to the NSW Office of the DPP with the agency deciding whether it will spearhead legal action against her.

The fraud case against Sydney lifestyle influencer Bianca Cheah has been referred to the NSW Office of the Director of Public Prosecutions and the agency is deciding whether it will spearhead legal action against her in court.

Cheah, who boasts more than a million social media followers, was arrested by NSW Police in December 2021 and charged with publishing false or misleading material to obtain an advantage.

Officers began looking into Cheah and her now estranged husband, American Simon Chalmers, after a civil action against the former couple by investors who had poured more than $1m into their digital marketing business called Sporteluxe.

Chalmers was not charged by NSW Police.

The investors had alleged they were misled by revenue figures increased by the inclusion of Cheah’s influencing and modelling income.

The NSW Supreme Court ruled in favour of the investors’ and found Cheah and Mr Chalmers had engaged in misleading or deceptive conduct.

Confidential can reveal Cheah’s case was recently referred to the DPP in the NSW Local Court.

The case against Cheah has so far been overseen by police, but now the DPP will examine the matter and decide whether it will prosecute her in the NSW District Court.

If the DPP decides Cheah’s case will be dealt with on an indictable basis, it will move up into that higher court.

When asked if the DPP would prosecute Cheah in the NSW District Court, a spokeswoman for the agency said: “No decision has been made as yet”.

As part of her bail conditions, Cheah must not enter any international airport and must not be in contact with any alleged victims or witness relating to the case.
