A man on bail allegedly lunged at a beachgoer with a screwdriver at a Ballina beach while disguising his face, a court has heard.
Tyreece Lee Snow was refused bail after appearing at Ballina Local Court House last week.
The 20-year-old was charged with common assault, three counts of affray, being armed to commit an offence, damaging property – under $2000, intimidation, two counts of reckless driving and three counts of negligent driving.
The Casino man is yet to enter any pleas.
Police will allege that Snow was at the northern section of Shelly Beach at East Ballina on the morning of September 4 wearing a full face covering, listening to “Arabic music” and drawing something in the sand.
Court documents state the victim was walking along the beach when Snow allegedly said to him: “F--k you, you miserable c--t. I’m going to get you.”
Snow was allegedly holding a black screwdriver when he lunged at the victim twice and reportedly said: “Touch my clothes and I’ll stab you.”
An hour later police tracked Snow down at Kmart in Ballina Fair Shopping Centre where he was arrested.
Officers allegedly found two black T-shirts and a screwdriver in his car.
Documents state that a few weeks beforehand, Snow approached a 69-year-old man – who was unknown to him – sitting at a bus stop on Brewster St outside Lismore Square Shopping Centre.
Snow allegedly yelled: “Hey grey hair, why don’t you turn around?”
The older man glanced at Snow who allegedly said: “What are you looking at? I’m going to smash you. Don’t look out there.”
The victim stood up and held his umbrella out in self-defence.
Snow allegedly grabbed the victim around his head and forcefully pulled him to the ground and held him down, police state.
A schoolgirl and her mother began filming the incident and told Snow to let the older man go.
Snow allegedly ran away towards Lismore Square Shopping Centre before being arrested and taken to Lismore Police Station.
Snow allegedly told police he mistook the victim for a pedophile.
The incident was captured on CCTV and recorded on the witness’ phone.
Officers also charged Snow with driving matters from September 3 when he allegedly drove on the wrong side of the road and kicked the side mirror off a car.
The court heard Snow is receiving a disability support pension, has been diagnosed with autism and receives NDIS care.
Defence lawyer Rebecca Witchard said Snow also had a bipolar diagnosis, doesn’t have secure housing and had no previous convictions.
Ms Witchard said Snow “wouldn’t have NDIS support in custody”.
Police prosecutor Val Short said Snow posed an unacceptable risk of endangering the public if granted bail. She said his offending included unprovoked attacks on two members of the public.
“Police said he was homeless and living in a vehicle,” she said.
Magistrate Kathy Crittenden said these extremely serious alleged offences were committed while on bail.
While Ms Crittenden acknowledged Snow was vulnerable in custody, she said granting him bail would risk the safety of the community.
Bail was refused and Snow is required to take a mental health assessment.
Snow will appear before Ballina Local Court on Thursday.
