A man accused of holding up a bank with a toy gun is back in court facing allegations he committed an armed break and enter police claim happened two weeks before the alleged heist attempt.

A Northern Rivers man accused of holding up a bank with a toy gun is back in court facing allegations he committed an armed break and enter police claim happened two weeks before the alleged heist attempt.
Steven John Kelly was mentioned in Ballina Local Court on Thursday, after pleading not guilty to two counts of intimidation.
Police state the 36-year-old had recently been placed on conditional bail when he allegedly threatened bank employees with a toy gun on River St, Ballina on December 5 last year.
Police have accused Kelly of entering a bank with a toy gun which had allegedly been stuffed down the waistband of his pants. He accused staff of giving away his money.
Kelly then allegedly threatened to shoot an employee’s legs on his way out, police facts continue.
The accused entered another financial institution on the same street, claiming he had money with them which he did not. He allegedly lifted his shirt revealing the gun secured in his waistband before leaving.
Police found Kelly shortly after allegedly carrying a black and blue coloured fake toy gun. No one was injured in the alleged heist attempts.
Court documents state two weeks prior, Kelly had been charged with aggravated break and enter while knowing a person was home, being armed with intent to commit indictable offence and entering a building to commit an indictable offence.
Kelly allegedly broke into a Fox Lane home in Ballina to steal on November 18, the documents continue.
Police will allege Kelly knew a woman was in the house when he offended.
He is yet to enter any pleas for these charges.
At court, Kelly was not required to appear from custody and Magistrate Kathy Crittenden adjourned his case to March 6
