A Gold Coast dad has been labelled a menace and threat after assaulting another man and a security guard in a matter of minutes at The Star casino.
Mitchell Andre Kriwat’s first target was another patron of the Broadbeach venue, kicking out at the man as he walked past with his friends in the early hours of August 4.
Southport Magistrates Court was told the other man backed away, but it did little to deter Kriwat, who handed one of his drinks to someone else before using his free hand to punch his victim in the face.
CCTV footage played in court showed the agitated 24-year-old being marched out of the casino surrounded by an increasingly large group of security guards.
Police prosecutor Sergeant Blair Casey said Kriwat again lashed out and spat at one of the security officers, with the spittle landing on the worker’s pants.
Kriwat took off on foot but was arrested a short time later.
The court was told the father had earned 40 hours of community service in 2021 for obstructing police and committing public nuisance.
Defence solicitor Danielle Egan, of Ashkan Tai Lawyers, said her client was extremely remorseful and that watching the CCTV footage for the first time in court was a confronting experience for him.
“Having (the facts) read out to him and reading them was already something that he found difficult to hear because he just doesn’t like the way he behaved on that night,” she said.
Ms Egan told the court Kriwat struggled with a difficult childhood and was dealing with other stresses at the time, but now recognised his issues with alcohol and had stopped drinking in addition to seeking treatment.
It was a path Magistrate Nerida Wilson urged Kriwat to stay on, slamming the alcohol-fuelled assault and “filthy, disgusting, and degrading act” of spitting.
“I’m not sure what you did not learn (when sentenced) three years ago – you are supposed to be three years more mature (and) have some understanding of what the consequences of those kinds of actions are,” Ms Wilson said.
“You are not only a menace, you are a threat to people who attend (venues).
“You need assistance and you need it very quickly before your life completely and utterly derails.”
Kriwat pleaded guilty to assault occasioning bodily harm and common assault.
He was placed on probation for 12 months and ordered to pay $750 in compensation to his first victim and $250 to the second. No convictions were recorded.
