David Richard Mifsud: Robina man arrested over alleged drug trafficking offences

A Robina man charged with a drug trafficking offence has been granted bail the day after his arrest. Read what happened here.

A Robina man arrested and charged with drug trafficking offences has been granted bail.

David Richard Mifsud, 39, was granted bail in the Southport Magistrates Court on Thursday, June 12 after being arrested the day before for drug related charges.

Court documents reveal Mifsud has been charged with trafficking marketable quantities of a controlled drug between February 19 and June 11.

The type of drug was not specified in court or court documents.

During the same time period as the alleged drug trafficking, Mifsud also allegedly failed to comply with an order under section 3LA (2) of the Crimes Act 1914

The section allows law enforcement to obtain an order from a magistrate requiring a person to provide information or assistance to data from a computer or data storage device.

A magistrate can grant the order if they are satisfied there are reasonable grounds for suspecting that evidential material is held in or is accessible from the computer or data storage device.

Mifsud is also charged with possessing cocaine on the day of his arrest.

No pleas have been entered.

Mifsud was not required to appear when his lawyer Jason Grant from Grant Lawyers applied for bail.

The court heard the Department of Public Prosecutions legal officer would not object to the bail if certain conditions were imposed including that Mifsud surrender his passport to the court and not leave Australia.

Magistrate Jane Bentley granted Mifsud bail under a number of residential and reporting conditions.

He is to report to Broadbeach Police Station every Wednesday, and reside at his Robina home.

Any changes to his reporting conditions must be approved by the Commonwealth DPP (Qld).

Mifsud has surrendered his passport and must not enter any or attempt to enter any international airport terminal.

His matter will appear in the Southport Magistrates Court on July 21 for a callover.
