A “sloppy and drunk” man who sexually assaulted and raped a terrified 17-year-old girl has been jailed.

Patrick Kreutzer, 39, was sentenced in the County Court on Friday to six years imprisonment by Judge Geoffrey Chettle, with a non-parole period of four years.

Kreutzer had pleaded guilty to two rolled-up charges – the first of sexual assault, encompassing three separate instances, and secondly a charge of rape, encompassing two non-consensual instances of sexual penetration.

Both charges stemmed from a single incident in 2022.

In his sentencing remarks, Judge Chettle told the court Kreutzer was 36 when he preyed upon his 17-year-old victim.

Judge Chettle said it was “extremely serious” offending by a “very, very intoxicated” Kreutzer.

“In your drunken state, you took advantage of a young woman who was terrified of you,” Judge Chettle said.

While brief, Kreutzer’s offending was “persistent” the court heard.

The victim described Kreutzer as “sloppy and drunk”, prior to the offending.

Kreutzer lay down beside the victim before groping and sexually assaulting her and digitally penetrating her vagina.

During the assault, Kreutzer removed the victim’s clothes and performed oral sex on her as she was “frozen with fear”, the court heard.

Then, he raped her.

Police found the victim crying and distressed, the court heard.

Kreutzer gave denials when interviewed, telling police he had no sexual contact with her “at all”, Judge Chettle said.

However, a medical examination of the victim proved otherwise.

In her impact statement, the victim described suffering nightmares, depression and anxiety, having difficulty sleeping and being diagnosed with PTSD.

She has lost trust in males and has since received medication and counselling the court heard.

Her mother also provided a victim impact statement.

Judge Chettle described Kreutzer’s childhood as “very unstable” – his father being a violent and abusive alcoholic and Kreutzer began drinking at an early age.

The court heard Kreutzer had a criminal history in both Queensland and Victoria, including offences involving alcohol-fuelled violence, however, he had no prior history of sexual offending.

Kreutzer, who has one son from a previous relationship, attended school to year 10, before working a variety of jobs, including in construction.

Judge Chettle said Kreutzer would receive a significant discount for his guilty plea, which saved the victim the trauma of giving evidence and the community the time and expense of a trial. He said Kreutzer had also demonstrated remorse.

But for his plea, Judge Chettle said he would have jailed Kreutzer for up to a decade.

Kreutzer was convicted on both charges and must register as a sex offender for 15 years.
