An Ocean Grove doctor has been accused of allegedly inappropriately touching a woman and asking her to “hold me tight”.

Police received a distressed call from a woman who alleged a doctor visited her home and sexually assaulted her during an examination.

A Norlane woman is the sixth patient to allege Grovedale doctor Shafiul Milky, who worked as a general practitioner at the Ocean Grove Peninsula Family Medical Practice, sexually assaulted her under the guise of performing legitimate medical assessments.

She alleged Dr Milky, 59, worked with the National Home Doctor Service in February 2019 and was tasked to see her.

The County Court heard on Tuesday morning Dr Milky arrived at her home at 10.46pm and started by massaging the sides of her neck before moving his hands down to her breasts and her backside.

Dr Milky has maintained his innocence and pleaded not guilty to charges of sexual assault, indecent assault and rape relating to six patients between September 2012 and February 2019.

During the last alleged incident, police claimed Dr Milky moved the woman so she was lying down and had her head by his crotch.

He then allegedly started massaging her breasts, pulled her top up and told her to “hold me tight, hold me closer”.

Dr Milky was also accused of allegedly moving his hand under the waistband of her shorts, grabbing her from behind, placing his hands on the inside of her legs and moving his hand towards her crotch.

The woman also alleged Dr Milky tried to kiss her six or seven times, forcing her to move her face to evade him.

He then allegedly tried to move her hand towards his crotch.

The five other women have alleged incidents inside his consulting room at the Ocean Grove medical centre.

Two of the women alleged Dr Milky digitally penetrated them.

During the opening address, prosecutor Richard Pirrie said a forensic physician reviewed the women’s statements and found the alleged examinations were “inappropriate”.

In the case of the last woman, the physician said his examination in her home was “so incompatible with appropriate practice”.

“The evidence reveals a pattern of behaviour … he used his position as a general practitioner to engage in touching or penetration that was sexualised and not warranted by legitimate medical purposes,” Mr Pirrie said on Tuesday.

Dr Milky’s lawyer, Theo Kassimatis, said their defence of the allegations is they “simply didn’t happen”.

“Alternatively the defence might be that what occurred was in fact consistent with sound medical practice,” Mr Kassimatis said.

Mr Kassimatis said they would rely on evidence from a nurse who was in the room during the examinations of two women who alleged rape and “will tell (the jury) she saw nothing”.

The trial is expected to last a fortnight.
