An Armstrong Creek carpenter who blew up at his site supervisor because he didn’t receive payment for his work, threatened to bash the victim and burn his works down.
Caleb Stubbs, 26, pleaded guilty in the Geelong Magistrates Court on Wednesday to using a carriage service to menace and was fined for his actions.
Stubbs, who was working at a construction company as a subcontractor carpenter, was furious with the site supervisors because he didn’t receive payment for his work.
Police prosecutor Senior Constable Kerrie-Ann Moroney said Stubbs was working as a framer at an address in St Leonards in October 9, 2022.
Just before 2pm on October 13, 2022, he sent a text message to the site supervisor requesting payment for the completion of the work.
The following morning the victim texted the accused to say he would pay him by October 21.
Stubbs was angered by this, and called the victim to express his frustration.
During the phone call, the court heard Stubbs said: “why are you being a f---ing smart----”.
“Pay me today or I will knock you on your a--- you old c---, I will burn your f---ing frames down and come and find you and bash you”.
Constable Moroney said the victim provided the text messages and phone records to police.
When police interviewed Stubbs in relation to the offending, Stubbs said there was an ongoing civil dispute and said the victim had been deliberately holding funds from him, which made him angry.
Stubbs represented himself in court and said prior to the incident, he was regularly speaking to the victim and developed a professional relationship.
“There was a heated phone call I was aware of, the stuff he was saying I don’t 100 per cent agree with,” Stubbs said.
Magistrate Peter Mellas convicted and fined Stubbs $300 for the offence.
