Bikies Matthew Rizzo, Toby Elvey front court over alleged Manhattan Bar bashings

Prosecutors are mulling an offer from a lawyer representing a pair of bikies accused of a savage attack in a Geelong bar, as fresh details of a victim’s injuries are compiled.

Prosecutors are mulling an offer from a lawyer representing a pair of bikies accused of savage attack in a Geelong bar, as fresh details of the injuries sustained by a victim are being compiled.

Matthew Rizzo, 30, and Toby Elvey, 42, both alleged to be patched members of the Bandidos outlaw motorcycle gang, appeared in Geelong Magistrates’ Court on Tuesday, charged over an alleged brawl in Manhattan Bar in Geelong’s CBD on October 22 last year.

Mr Rizzo, of Winter Valley, is charged with nine offences, including intentionally causing serious injury in circumstances of gross violence, intentionally causing serious injury, assault without lawful excuse, affray, possessing cannabis and two counts of possessing a prohibited weapon.

Mr Elvey, of Pascoe Vale, is charged with eight offences, including intentionally causing serious injury in circumstances of gross violence, assault, affray, dealing with property suspected to be the proceeds of crime, handling stolen goods and two counts of committing an indictable offence on bail.

Mr Rizzo, sergeant at arms of the Bandidos Ballarat chapter, Mr Elvey, president of the Melbourne chapter, along with fellow Bandido, Marty Albert, are alleged to have attacked two other men without provocation during a night out in Geelong.

Police do not believe the parties were known to each other.

At Mr Rizzo’s bail application last year, CCTV footage played in court showed one of the alleged victims being grabbed by his jumper’s hood, before he was flung to the floor and smashed his head on a table.

The court heard the victim was then punched repeatedly in the face and kicked twice in the head while unconscious.

The man was allegedly left with a broken nose, facial fractures and nerve damage resulting in partial face paralysis.

Police alleged the second victim was also repeatedly punched, and suffered numerous injuries including a sore tailbone and a bite mark to his cheek.

The court heard the prosecution was awaiting an updated report on injuries received by the first victim, which would be available next month.

The pair’s lawyer, Micky Milardovic, told the court he had made an offer to the prosecution on behalf of his clients, but understood the prosecution would not be in a position to make a decision until the updated injury report was available.

Mr Milardovic also lodged an application for the return of property seized during the execution of a warrant.

Magistrate Ann McGarvie adjourned the matter, and all applications, until June 18, and the two men’s bail was extended.
