Bailey Miller, 22, fined for sexually exposing himself to women in Colac and Sebastopol

A young man who exposed himself to women has been fined for his offending.

A young man flashed his penis at two women on separation occasions as part of “exhibitionist behaviour”.

Bailey Miller, 22, now living in the Mornington Peninsula, pleaded guilty in the Geelong Magistrates Court on Tuesday morning to sexual exposure in a public place and engaging in sexual activity intended to cause fear and distress.

Miller was walking in Colac when he spotted an 18-year-old girl walking home from work on February 15 this year, just after 6.30pm.

Police prosecutor Senior Constable Kylie Jane said the victim was walking home and quickly became aware Miller was walking behind her.

Constable Jane said Miller walked past her, then faced her, placed hand inside his shorts before walking past her again.

The victim observed Miller remove his penis from his shorts and began to masturbate in direct view of the victim.

“He continues to masturbate while walking past and is then observed on CCTV footage walking back to the Colac train station where he enters a Blue Mitsubishi,” Constable Jane said.

In a separate incident on February 9, Miller walked into a 7/11 in Sebastopol.

The court heard Miller paid for a number of food items and then lifted his singlet up revealing his erect penis.

“He completed the transaction while his erect penis was fully visible,” Constable Jane said.

“The victim panicked and attempted to ignore what occurred before he left,” she said.

Miller’s lawyer, Bill Sizeland, said his client was previously living in the Colac region but was now residing on the Mornington Peninsula.

Mr Sizeland said his client had been under significant stress as a result of a break up and was trying to work out why he behaved in this way.

During Miller’s interview with police, Mr Sizeland said his client was cooperative and remorseful and realised his victims would have felt terrible.

Mr Sizeland said Miller was a young man with enormous potential who was working to address his behaviours.

“He’s prepared to tackle whatever it is that has motivated the behaviour on those two occasions,” Mr Sizeland said.

“It’s exhibitionist behaviour, he is not trying to draw them into his behaviour, he has fled both the incidents very quickly,” he said.

Magistrate Franz Holzer fined Miller $2000 without conviction.

“I very much hope that you don’t repeat this kind of behaviour in the future,” Mr Holzer said.

“Because no doubt in each instance the effect on the people is really something that you should be thoroughly ashamed of,” he said.
