A prominent Gold Coast tycoon has breached a suspended jail sentence imposed for defrauding superannuation funds by sideswiping a vehicle while driving under the influence of alcohol.

Mermaid Beach man Craig Kirrin Gore, 58, whose father Mike Gore developed ritzy enclave Sanctuary Cove in the 1980s, appeared in Southport Magistrates Court on Wednesday, July 30, where he pleaded guilty to a charge of mid-range drink-driving.

The offence occurred at about 4.10am on November 21 last year at Cavill Ave, Surfers Paradise.

The court heard police who were in the area were flagged down by a motorist, who said they had been sideswiped by a vehicle that had then taken off.

Moments later, Gore returned to the scene to confess he was the driver that had struck the vehicle.

Gore was breath tested and returned a positive reading of 0.114 per cent blood-alcohol content.

Defence lawyer Terry Fisher told the court his client was moving his friend’s vehicle, which he was using, from a loading zone when he accidentally clipped the other vehicle.

He said his client had been celebrating a successful business deal the night prior, which explained his alcohol reading.

Mr Fisher said Gore had been forced to pay $4800 to repair the damage to the other vehicle, plus an additional amount to fix his friend’s car.

Magistrate Gary Finger fined Gore $800 and disqualified him from driving for the mandatory minimum of three months, in light of Gore’s licence being provisionally suspended since the offence date.

The court was told the delay in finalising the matter was attributed to the defendant’s being in Sweden, with a back injury preventing him from flying home sooner.

However, Gore’s legal travails are not over – the current offence breached a partially suspended sentence imposed by the Brisbane District Court in November 2020.

On that occasion, Gore was sentenced to five years’ imprisonment, suspended after serving two years, after being found guilty of defrauding $345,000 from a series of self-managed superannuation funds.

Magistrate Finger committed Gore back to the district court for resentencing on a date to be fixed.

Options open to the court include ordering him to serve all or some of the outstanding three years’ imprisonment – unless it would be unjust to do so – or extending the operational period of the suspended sentence.

Gore previously tried to plead guilty to the DUI in absentia, but the matter was unable to proceed due to the suspended sentence breach.
