Kathy Rado’s second attempt at taking Golden Casket to court dismissed

Cairns woman Kathy Rado has spoken out about the reasons she took Golden Casket to court for a second time over an unclaimed $2 million lotto ticket from a draw in January 2014.

AFTER a second dalliance with taking Golden Casket to court, Cairns woman Kathy Rado says she’s finished with chasing after the company over claims she purchased a winning, unclaimed $2 million lotto ticket from a draw in January 2014.

Ms Rado lost her first application in the Supreme Court in February, where she sought for Golden Casket to disclose the time and date the winning ticket was sold at DFO in Westcourt in January 2014.

Ms Rado believed she was the rightful winner of the money and lost the ticket, but has spent the past seven years hoping to receive the windfall and making multiple failed claims.

In court on Friday, Ms Rado said her second claim was not about the money, but rather for “disclosure”, to show that her fight was not without reason.

Justice Jim Henry gently explained to Ms Rado that in making her application to the court for costs and the payment of just 10 per cent of her claimed winnings – $250,000 – “the very nature of what you’ve embarked upon this time … has the same fatal problem that you had last time”.

“So there’s a sort of deja vu feeling to this.”

Justice Henry said the reasons he gave at the start of year for dismissing Ms Rado’s application held true on this occasion.

“In a legal sense that nature of the relief I’ve just identified demonstrates the unsuitability of it being pursued through an application,” he said.

He awarded the costs of the application to Golden Casket.

Speaking outside court after her application was dismissed, Ms Rado said even though she didn’t win, it was something she had to do.

“And really its not about the money, it’s just about disclosure, like, I’ve fallen apart over it,” she said.

“And I just wanted the validation. Even if I got the time wrong by a minute, it still would have said to me yes, that’s yours. But they’ve got their rules and they won’t pay it. (Golden Casket) just gave me a hard time.”
