AFP lays charges over another alleged visa breach following NZYQ decision

A Sudanese man has been charged after allegedly breaching his visa’s curfew conditions, as the NZYQ fallout continues.

A Sudanese man has been charged with an alleged visa breach, joining several former detainees released following the High Court’s NZYQ decision who have since returned to face the courts.

The Western Sydney man, who the Australian Federal Police did not identify, is scheduled to appear before the Blacktown Local Court on Tuesday where he will face two alleged breaches of the Migration Act.

It is alleged he failed to comply with a curfew condition and failed to maintain his mandatory monitoring device.

If he is found guilty he could face a maximum of five years in prison and $93,900 in fines.

Police will allege he breached his visa conditions between May 9 and May 13.

The AFP did not provide information on whether the accused was on a Bridging ‘R’ visa, which was provided to 149 former detainees, but the curfew and monitoring conditions breached here are requirements of that visa type.

On May 3, Kimbengere Gosoge, 42, was arrested for alleged visa breach in Perth, while Nahi Al Sharify, 40 was arrested for the charge on February 25.

Mr Gosoge faced the same charges as Tuesday’s accused regarding a failure to comply with curfew and keep his monitoring device in working order.

Mr Al Sharify repeatedly failed to report to police as directed under his commonwealth visa conditions.

There has been a steady stream of alleged non-compliances among the former detainee community since their release in November.

More than two dozen former detainees have been charged following the decision that indefinite detention was unconstitutional, emergency legislation passed at the end of last year sought to place more stringent security demands on those released.

Documents tabled in Senate estimates last February revealed a breakdown of the crimes committed by individuals in the group of former detainees, which included seven murderers, 37 sex offenders and 72 convicted of violent offences such as assault, kidnapping or armed robbery.

There is no suggestion Mr Gosoge, Mr Al Sharify or the man charged today have ever committed any such offence.
