The man alleged to have killed three people in an ‘execution-style’ shooting and is accused of attempting to murder another has applied for bail.

The man who faces the possibility of spending 30 years or more behind bars after being charged with the triple murder of a Queensland family and the attempted murder of another has applied for bail and failed.

Accused Bogie shooter, Darryl Valroy Young who is alleged to have shot and killed Mervyn and Maree Schwarz and Maree’s son Graham Tighe at a cattle property west of Bowen was refused bail after the judge labelled him an “unacceptable risk” of flight and of committing an offence.

In Townsville Supreme Court on Friday, defence barrister Douglas Wilson submitted on the 61-year-old’s behalf that he could be restricted to tight conditions such as having to reside at a certain address with ankle monitoring, curfew conditions, abstaining from drug or alcohol use and reporting to police daily.

Additionally, it was suggested he were to have no communication with the sole survivor Ross Tighe, who it is alleged Mr Young shot in the back.

Mr Wilson offered two housing options for Mr Young if granted bail, both owners of the addresses being his sisters, with defence stating there would be no technical issues with ankle monitoring at the locations.

Crown prosecutor David Nardone said the address proposals offered no assistance as to whether it was unjustified that Mr Young stay behind bars.

He said one of the properties that had been offered was done so “out of obligation or pressure from the family” and was described as a small property which could cause clashes between the owner who had to look after her mother and Mr Young.

The second address proposed was owned by a witness who had “proved loyalty” to Mr Young by not co-operating with police when asked for a statement, the crown said.

“The nature of the offence itself is particularly significant, the risk of flight is high,” Mr Nardone said.

“The minimum non-parole period is 30 years, after trial there is no doubt in my mind this crown will be urging this court to be fixing a parole eligibility date beyond that 30 year mark given the number of people killed and the attempt to kill a forth.

“The evidence itself in terms of the seriousness of the offending could at best be described as callous and at worst in the nature of execution style killings.”

Mr Nardone said the prosecution’s case had “strength” to it, as it involved evidence from the sole survivor,

While it had been argued earlier by defence that Mr Young’s criminal history was dated and irrelevant, Mr Nardone said he had been convicted of a charge relating to failure to deal with weapons properly, and as the current case involved a firearm it wasn’t “entirely irrelevant”.

“The burden placed on the shoulder of the applicant has not been overcome and this court would refuse the application,” the crown said.

Justice David North, when considering the application, acknowledged Mr Young had spent 911 days in custody already and said granted bail never involved “no risk” and that his main concerns involved deciding what risks were deemed to be “acceptable or not acceptable”.

“I remain of the view that the risk of flight and reoffending are so serious in the context of this case that the bail application should be refused,” he said.

“The risks are unacceptable and the applicant has not satisfied me that the grant of bail can be made that will sufficiently reduce relevant risks to an acceptable level.”

The lawyers told the court the charges were ready to go to trial in which His Honour adjourned the matter and listed a two-week trial date for July 14 before Townsville Supreme Court.

Mr Young was remanded in custody.
