A man accused of stalking supermodel Miranda Kerr has been declared mentally unfit to stand trial.

Australian man Shaun Haywood, 31, remains in custody in the US over a 2016 incident in which he entered the grounds of Kerr’s home in California and attacked her security guard with a knife.

He has been held in Los Angeles jails and mental health facilities on $US1.05 million ($A1.55 million) bail since his arrest outside Kerr’s home almost three years ago.

The former boxer will be kept in a psychiatric hospital for another 16 months until he is “competent” to answer to his alleged crimes.

A court has ordered Haywood to report to authorities every three months until he is found to be in a state to properly face the charges, which include attempted murder.

At the time of the incident, Haywood claimed he was insane when he went to Los Angeles-based Kerr’s Malibu home and became involved in a violent tussle with a security guard, where a gun was fired.

He has remained behind bars in California since his arrest, and had entered not guilty pleas by reason of insanity to attempted murder and other charges in a Los Angeles court.

In September last year he was ruled competent to stand trial. But during an appearance in Los Angeles Superior Court, Judge Alan Schneider was told new assessments by defence and prosecution psychologists concluded Haywood unfit.

“In view of that the court finds the defendant is not competent to stand trial,” Judge Schneider said.

Haywood, from the NSW Central Coast, was escorted into court dressed in a thick blue safety smock. He was also handcuffed.

Haywood claimed during the proceedings that his bail had been paid before the psychologists filed their recent reports.

Judge Schneider responded there was no record of that in the court file. Haywood’s future continues to remain in limbo behind bars.

A hearing next month will determine the type of facility in which Haywood is to be held.

He was arrested outside Kerr’s home on October 14, 2016 after allegedly engaging in a violent struggle with the model’s security guard. Authorities allege Haywood attempted to deliver Kerr a letter. He allegedly grabbed the guard’s knife and slashed his face. The guard responded by shooting Haywood, according to authorities.

Kerr was not home at the time.

Haywood was charged with attempted murder, aggravated mayhem and assault with a deadly weapon and if convicted faces a potential life prison sentence.
