Police have applied for an apprehended violence order on behalf of popular Fitzy & Wippa host Michael Wipfli against one of his fans.
Lisa Christian, who runs a website devoted to the Nova 96.9 breakfast star, appeared before Downing Centre Local Court for a brief mention on Wednesday where her lawyer said she opposed the application.
Deputy Chief Magistrate Jane Mottley said the case may raise questions about the appropriateness of making AVOs against people with cognitive impairments, before adjourning the matter to next month.
The court had received a letter advocating for Ms Christian from a staff member at South Western Sydney Local Health District, Magistrate Mottley said.
Neither the duty lawyer representing Ms Christian nor the police prosecutor had seen the letter, which Magistrate Mottley described as an out-of-court communication.
“It’s very unusual in the way it’s come to the court,” she said.
She said based on the small amount of information she had, the case ran the risk of a “Phipps v Farthing situation”, a reference to a 2010 case about the appropriateness of making AVOs against people with some cognitive impairments.
Ms Christian’s lawyer said at this stage she had instructed him to oppose the AVO application.
Magistrate Mottley ordered the police prosecutor to file material supporting the application, saying “that might focus everybody’s mind on how the matter should progress”.
The matter was adjourned to August 4.
