CCTV footage of accused mushroom cook killer Erin Patterson buying snacks at a service station the day after the lethal lunch has been played to the jury in her murder trial.

The footage revealed Ms Patterson, wearing a grey sweater and cream pants, spent nine seconds in the toilet of a BP in Caldermeade on July 30, 2023, on the way to her son’s flying lesson in Tyabb on the Mornington Peninsula.

The Supreme Court jury has previously heard from her 14-year-old son, who gave evidence that his mum told him that morning that she was “feeling a bit sick and had diarrhoea”, but would still drive him to his lesson.

Ms Patterson is standing trial in Morwell, accused of murdering her estranged husband’s parents Don and Gail Patterson, both 70, along with Gail’s sister Heather Wilkinson, 66.

She served them individual beef wellingtons allegedly laced with death cap mushrooms at her home on July 29, 2023.

But the prosecution alleges that Ms Patterson’s serve did not contain poisonous mushrooms and that she feigned illness in the days after to “cover that up”, while the defence claim she was “just not as sick” as the others.

Heather’s husband Ian Wilkinson, 71, was the only guest to survive. Ms Patterson, 50, has pleaded not guilty to three counts of murder and one count of attempted murder.

Detective Senior Constable Khuong Tran, from the homicide squad, told the court on Tuesday he obtained CCTV footage from the BP in August.

In the footage, Ms Patterson can be seen walking into the service station about 3.19pm and entering the toilet, before exiting nine seconds later.

She can then be seen looking at sandwiches in the fridge section and grabbing one from the shelf, before walking over to the confectionery area.

In its opening address to the jury, the prosecution said Ms Patterson bought “a type of sour confectionery, a ham, cheese and tomato sandwich and a sweet chilli chicken wrap” before leaving about 3.22pm.

In his pre-recorded evidence, Ms Patterson’s son said his mum was drinking coffee on the morning of July 30 when she told him “she had woken up a few times in the night to have to go to the toilet”.

He later added: “She was just hoping we could make it to Tyabb before she needed to go to the toilet again because she had diarrhoea.”

Earlier Tuesday, digital forensics expert Dr Matthew Sorell was cross-examined by defence barrister Colin Mandy SC about the opinions he had drawn from Ms Patterson’s phone records as he attempted to cast doubt on the reliability of this data.

Dr Sorell told the court on Monday it was his opinion that the mobile phone made a “possible visit” to Loch on April 28, after death caps were logged in the area on the iNaturalist website on April 18. But he agreed with Mr Mandy that there were no records that showed the mobile phone was “definitively” in the boundary of the Loch township.

Dr Sorell also told the court on Monday it was his opinion that the mobile phone made a “possible visit” to Outtrim on May 22, after death caps were logged in the area on iNaturalist on May 21.

He agreed with Mr Mandy that there also remained a possibility that the mobile phone did not enter the Outtrim postcode area on May 22.

The trial, before Justice Christopher Beale, continues.
