Police still have no idea who stabbed 19-year-old Girum Mekonnen to death two months after he died in a violent gang brawl at Zillmere, a court has heard.
The revelation comes as a judge rebuked “misleading” evidence put before him during a bail application of one of the 13 men charged with the murder in the Brisbane Supreme Court.
Justice Peter Callaghan said the assertions made against 18-year-old Majok Reil Majok in a prosecution affidavit filed with the court were “simply not true” and created “false expectations” for victims, their families and the wider community.
“In this case the prosecutor and I were furnished with an affidavit in which it was asserted that the applicant had played an active part in a murder and that he had participated in inflicting fatal and serious injuries by beating victims repeatedly with bats before they were chased down and stabbed in a series of frenzied attacks,” he said.
“Those assertions are simply not true.”
Justice Callaghan made reference to comments by America’s Vice-President-elect Kamala Harris that it was essential the exercise of prosecutorial power be informed by accurate information.
“It will be apparent from what I’ve said that there is no direct evidence of him playing an active part in anything or that he participated in inflicting any injuries on anyone with anything,” he said.
“There is a real danger that by making misleading assertions in affidavit material such as that which has been placed before me, false expectations are created in the minds of victims, families of victims and friends of victims and indeed in the mind of the wider community.”
The court heard detectives still had no idea which of the 13 men had allegedly stabbed Mekonnen.
“I can say that in respect of this applicant the case against him reduces to the propositions that (one) he was present near some cars which were subsequently observed at the location in which a murder took place,” he said.
“(Two) that his fingerprint and some of his blood was found on one of those cars which was owned by someone that he knew and which could have been placed upon the vehicle at absolutely any time.
“Three, the potentially relevant use of his telephone absent any evidence it was actually in the possession of the applicant and finally a gash observed the applicant’s forehead which is suggestive of his involvement in a recent altercation.”
Majok, who is charged with murder, affray and 12 counts of acts intending to cause grievous bodily harm, was granted bail on conditions including that he provide a surety and wear a tracking device.
He is the fourth of 13 men charged over the deadly brawl at Zillmere in September to be granted bail.
