A man slapped with a speeding fine went to extraordinary lengths to get out of paying it, including lying on a statutory declaration.

A man desperate to get out of paying a speeding ticket made a false declaration and passed the blame onto someone who hadn’t lived in the country for more than two years.

No violence was involved in Daekyu Lee’s offending but Magistrate Aaron Simpson said his actions struck at “the administration of justice” and warranted a jail term.

The 25-year-old tiler won’t spend a day behind bars but now has a lengthy suspended prison term hanging over his head.

Lee pleaded guilty at Richlands Magistrates Court on Monday to knowingly making a false declaration in a material particular and dishonestly inducing the commission of police to reissue a fine.

The court heard Lee was issued a fine in January last year after being caught by a speeding camera in Paddington.

Instead of paying the fine, he made a statutory declaration that another man was driving the car.

Police later discovered the man had departed Australia in July 2018.

Police prosecutor Sergeant Shane Stephenson said Lee had obtained the man’s details from a Brisbane website and had emailed the company to get the man’s licence details.

“You went to some length to find out the details of someone who was not here, to make an active deception,” Magistrate Simpson said.

After being interviewed by officers in April, Lee made admissions to the deceit.

Sgt Stephenson asked for a jail term due to the “serious” dishonesty at play.

Defence lawyer Rhys Foster instead pushed for probation or a community service order due to Lee’s lack of criminal history.

He said Lee was afraid of a licence suspension at the time, despite not being close to any suspension.

Magistrate Simpson sentenced Lee to three months’ jail, suspended for 18 months.

“You would have known police, acting on that (declaration), would have assigned that fine to someone else who was not responsible at all,” Magistrate Simpson said.

“In my view, it is beyond a fine.”
