A Brisbane-based actor who appeared in Boy Swallows Universe has had an unlawful stalking charge dropped in court.

Sacherence Pio Fuifui Sitagata, 22, appeared in Brisbane Magistrates Court for one charge of unlawful stalking, intimidation, harassing or abuse in a domestic violence offence.

However, police prosecutor Sergeant Messina told the court they would be dropping the stalking charges made by his ex-partner that he had been together with for four years.

Sgt Messina said the contact was obviously not wanted by his ex-partner.

“On one occasion, the aggrieved, got in her vehicle and drove into an underground car park to escape being located by the respondent,” he said.

“Despite her actions, she was located, and there was an interaction between them.

“On a second occasion, the aggrieved reports the defendant followed her to the gym while she worked out and waited for her outside.

“There was no way for her to avoid that interaction, and it was unexpected, and she outlines the trauma that has caused her, and again, in her victim impact statement, the ongoing trauma, she still suffers.”

He said there was another incident which involved his ex-girlfriend’s new partner.

“There was a matter that could be considered a road rage incident,” he said.

“However, in the light of a domestic violence setting whereby the aggrieved new partner was set upon, what I would describe as a dangerous situation being in a vehicle.

“Then an accident has occurred. I do acknowledge that no complaint has been made in relation to that incident.

“The defendant has not been charged, it is not before the court but I have submitted it as an aggravating circumstances that actual violence has occurred.”

Sgt Messina said Sitagata continued to send messages saying he would end his own life and he was not coping with the breakdown of the relationship.

The court heard he was 21 at the time of the offending, he doesn’t have a criminal history and studied acting at the Queensland University of Technology, graduating in 2023.

Defence lawyer Zoe Kansky said he has been acting since that time.

“He received a scholarship through QUT only two people per year received that scholarship, so it’s quite a prestigious one, and it allowed him to complete his degree, which was compensated by the university,” she said.

“Ultimately it’s the career he wants to pursue.”

She said he did not have any physical health issues but struggled with his mental health and his feelings of anxiety and depression.

She said they were at the end of the relationship at the time of the offending.

“He admits that he should have moved on, he tells me this was his first girlfriend and this was his first relationship ever,” she said.

“He instructs me that after being charged, reality really set in. He’s had time to reflect and completely recognises that his behaviour was far more serious than a difficult break-up.

“He is remorseful and ashamed of his actions, and he has insight into his offending.”

Ms Kansky said it was out of character and he played an integral role in his church community, being a role model to some of the younger persons.

Magistrate Adam Johnson said he was very lucky after the incident involving his ex-partners new partner.

“Now you’re not charged with assaulting the new partner, and that’s very lucky for you, because had you been charged, you would certainly be looking at a very lengthy sentence imposed by me,” he said.

“Resorting to violence is appalling. The effect on the aggrieved in this case was that she observed all of this happening in the context that she was in the same car, attempted to escape.

“The violence she observed was continuing in her presence, eventually she had to pull you out of the vehicle, jump into the passenger seat and her and her new partner sped off to and rushed away and crashed into a number of vehicles.”

He said Sitagata was only young with his whole life ahead of him.
