The case against a man charged with the death of his newlywed wife following a buggy crash on one of Queensland’s most famous islands has faced further delays.
Robbie Awad, also known as Robbie Morgan, was on his honeymoon with new wife Marina Morgan on Hamilton Island, when the couple were involved in a golf buggy incident on June 20 last year.
Police alleged in court Mr Awad rolled the golf cart while attempting a U-turn on the corner of Coral Sea Ave and Whitsunday Boulevard.
As a result, his 29-year-old wife died despite the attempts of an off-duty firefighter, a doctor and dentist to save her.
Mr Awad, 30, was not injured in the crash.
Mr Awad is charged with driving without due care causing death, of using a mobile phone while driving, of not wearing a seatbelt, and not have passengers 16 years or older wearing a seatbelt.
Mr Awad pleaded not guilty to the charges on the first mention of the case on December 6, 2022.
The matter was mentioned once again in Proserpine Magistrates Court on Monday after it had been adjourned on multiple occasions in the past year.
Magistrate Michelle Howard asked Awad’s legal team and police prosecutor Sergeant Emma Myors if they had managed to discuss dates for a four-day trial set for next year.
Murphy’s Lawyers defence solicitor Bryan Wrench said they had not managed to get in touch with prosecution after they called them last Friday.
Ms Howard asked Mr Wrench why the legal team had only made contact a few days ago as the last mention date for the case had been weeks ago, to which Mr Wrench responded they had tried to get in touch beforehand.
“It sounds like it’s the prosecution that needs to respond at this point,” Ms Howard said.
“I would urge you both to progress the matter.”
Mr Wrench asked for a short adjournment to discuss “practicalities” of the matter with prosecution.
The case will be next mentioned on December 20.
