Man charged over punch attack on 61-year-old at Park Ridge South

A man has been granted bail after he faced court charged with causing grievous bodily harm after a fight at his home that left a man requiring surgery to remove part of his skull.

A man accused of an “abhorrent attack of violence” after he claims his testicles were squeezed by a house guest who was allegedly kicked in the face while on the ground has been granted bail.

Daniel James Martin, 33, faced Brisbane Magistrates Court on Saturday charged with one count of acts intended to cause grievous bodily harm.

The court heard the alleged victim, aged 61, went to Martin’s Park Ridge South home on Friday to do some handyman work.

Police prosecutor Tahlia Boettcher said a “consensual” fight broke out between the pair in the evening.

“That consensual fight is probably quite heated giving consideration to the (alleged) fact that the victim has had to grab the defendant’s neck and testicles whilst keeping a grip on them,” she said.

Martin’s fiancee has intervened and the defendant went to the backyard to cool off.

However police will allege when Martin, who has no criminal history, entered the Stony Camp Rd home he attacked the man, punching him and causing him to fall and hit his head.

“Triple zero had to be called before commencing chest compressions on him until police arrived,” Ms Boettcher said.

“The victim was transported to the PA hospital as his condition deteriorated quickly and he actually had to be intubated and have emergency surgery to remove a part of the skull to relieve the swelling and bleed on the brain. He is expected to survive.

“This is an incredibly serious injury that the victim has sustained under the hands of the defendant.”

Ms Boettcher alleged Martin had made admissions to police of kicking the man to the head head and face while he lay on the ground.

“It does appear that your honour can draw reasonable inferences … that he was kicking the victim whilst he was unconscious on the ground, which is a completely abhorrent act of violence on the victim ,” she said.

Martin’s Legal Aid duty lawyer Ann-Maree Russo made an application for bail which was opposed by police.

Ms Russo said her client may have a defence open to him of provocation but this would not be known until the full brief of evidence was provided.

“It’s in a context of what seems to be a consensual fight, the initial protagonist being the victim in this matter. So there’s still a lot yet to be uncovered,” she said.

Ms Russo said her client had been cooperative with police and posed no risk of committing further offences or failing to appear in court when required.

Magistrate Peter Saggers granted bail with conditions including Martin report to police twice a week and not to contact the alleged victim.

“I don’t want anything to do with him,” Martin, who was appearing by video link, said.

The matter was adjourned to October 9 at Beenleigh Magistrates Court.
