A man previously acquitted of murder has again been charged in relation to a 2009 case after police say they received “fresh and compelling evidence”.
Logan Detectives in conjunction with the Homicide Investigation Unit made the arrest, which is the second time in Queensland that the Double Jeopardy legislation will be exercised. Application will be made to the Queensland Court of Appeal to apply for a previously acquitted person to be retried for the offence of murder.
Police claim they received “fresh and compelling evidence” in December.
Detective Inspector Chris Knight said this arrest illustrates the persistence of investigators to achieve justice for victims of crime and the importance of members of the public sharing information with police.
No further details were given about the accused or the case due to legal restrictions preventing the publication of information identifying a person who is the subject of an application to be retried under exception to double jeopardy provisions.
