Kym Cobby murder trial hears recording of accused’s cries

The murder trial of Kym Cobby’s estranged husband has heard a recording of his reaction to news of his wife’s death.

A man accused of murdering his wife in a brutal attack outside her Gold Coast home wailed and screamed when a police officer told him she had died.

A recording of Andrew John Cobby in the hours after his estranged wife’s Kym’s body was discovered beaten and bloodied was played to his Brisbane Supreme Court murder trial on Tuesday.

While in hospital after the discovery, a police officer is heard telling Cobby that Kym has died.

Wailing and screaming, Cobby tells the officer: “I was supposed to protect her, no, no.”

“I’m sorry Kym, I was supposed to protect her, no, no, you’re wrong,” he says.

“No please tell me it’s not true.”

Through screams and wails, Cobby says Kym is “the love of my life”.

“No please, no help her, I’m a coward I ran, I should have stayed to protect her,” he says.

“No please, it can’t be.”

Ms Cobby’s body was discovered by her brother-in-law outside her Worongary home on the night of November 12, 2017.

The crown alleges Cobby killed his estranged wife in a violent attack but he claims they were in fact ambushed by an unknown person and that he ran from the scene to save himself.

In the recording played to the court on Tuesday, Cobby tells police he went to the home that night at Kym’s request because she was concerned for her safety because people were trying to extort the family.

“We’ve been to the police,” Cobby tells the officer.

“Kym has been petrified, she went there of her own accord to tell you guys what’s going on.”

He said on the night of her death, Kym had called or messaged him to say she was worried and asked him to come over.

Through tears, he again tells the police officer: “Please tell me it’s not true.”

“I’m a coward,” he says.

Cobby tells officers he feared he would be attacked by the unknown assailant whom he claims ambushed Kym.

“Kym had taken the brunt and I remember thinking I’m next

“He was on top of Kym, and I’ve laid over Kym trying to protect her. I got hit in the back of the head I think.”

Cobby tells police he ran from the scene down a hill and that he tripped several times as he fled.

Cobby has not pleaded guilty to murder. The trial continues.
