Albany Creek man Jeffrey Alan Nejaim faced a committal hearing in Brisbane Magistrates Court on Friday charged with one count each of attempted murder, acts intended to cause grievous bodily harm and dangerous operation of a vehicle.
The court heard Nejaim allegedly drove his van towards the child at an increasing speed and hit him, before reversing at speed and driving off on January 10, 2024.
Nejaim allegedly returned about a minute later to the child’s parents’ house and drove into a vehicle parked in the carport while the child and his mother were nearby.
Defence barrister Edwin Whitton submitted that there was insufficient evidence whether Nejaim had a subjective intention to cause the death of the child.
But Magistrate Rosemary Gilbert said she found there was evidence of animosity between the defendant and the victim’s family.
“The case relies on a significant degree on the footage of the incident which clearly is compelling evidence with respect to the charge of attempted murder, and clear evidence in respect to the charge of dangerous operation,” she said.
Ms Gilbert committed Nejaim to stand trial at Supreme Court of Queensland in Brisbane on a day yet to be fixed and asked if he would like to say anything to answer the charges.
“No, I don’t, your honour,” Nejaim said.
The child’s father, who cannot be named to protect the child’s identity, told The Courier-Mail the hearing was a positive outcome.
“I think the judge [magistrate] saw it how it is and let’s see,” he said.
He said his son still had nightmares two years after the incident.
“It’s just more emotional … What I want more than anything is that he never comes back to this area,” he said.
“If that happens, I can sleep easy.”
