A father of eight has avoided serving jail time after being sentenced for a heinous three-day campaign of abuse on his then-partner.

The Goondiwindi region man in his 40s – who cannot be identified to protect the victim – was in a relationship with his victim for roughly six months before the offending period.

Over three days in November 2023, a reign of offending “rooted in an argument” occurred.

Crown prosecutor James Coghlan told the court the man’s abuse came after the man asked his then-partner to leave the address.

The court was told he tried to push her down the stairs, and dragged her by the ankles, Mr Coghlan detailed.

Moments later, the man was told to leave her alone, to which the man put his hands over her mouth and nose for around a minute.

“Shut the f--k up and do as I told you,” the man said to the woman as he strangled her, the court heard. The woman urinated herself during the strangulation.

A day later the man held a knife and made a threat to the victim, before on the final day, the victim was in bed when the man approached her.

“(He) grabbed her by the arm, which caused bruising and has thrown her off the bed, (she) hit her head and ran to the bathroom to call the police,” Mr Coghlan said.

Immediately following his arrest on November 6, 2023, the man was placed in custody, serving 368 days until he was sentenced in court.

“The offending had an effect on her, it was serious and persistent offending over a series of days,” Mr Couglan said.

The man pleaded guilty to four charges on November 7 in Warwick District Court, common assault, suffocation, threatening violence and assault occasioning bodily harm.

All four charges were domestic violence offences.

Defence Barrister Mitch Rawlings said the former concreter’s offending was a “flashpoint” and “out of character.”

The court was told the father of eight had also contravened a DVO in 2020 which was taken out by another woman.

Judge Craig Chowdhury said a “turbulent and dysfunctional” relationship led up to the offending, and said it had an “adverse effect” on the victim.

“She thought you were going to kill her which is not surprising in these circumstances,” Judge Chowdhury said.

The judge said that domestic violence continued to be a major problem within communities.

“Most relationships have arguments and stressful moments but should never result in violence,” he said.

“Your kids would want someone who’s hard working and not in jail.”

The man was sentenced to three years’ imprisonment, with immediate parole release after 368 days in custody were declared as time served.
