Cross River Rail subcontractor UGL to join forces with CPB against CFMEU in Federal Court

Cross River Rail subcontractors are looking to join forces with the lead contractor as it takes on the embattled CFMEU in court, as they seek damages for alleged picketing and use of “unlawful tactics” on sites.

Cross River Rail subcontractors are looking to join forces against embattled CFMEU in court, as they seek damages for alleged picketing.

The Federal Court in Brisbane heard during submissions on Tuesday that Cross River Rail subcontractor UGL is seeking to join lead contractor CPB Contractors in its ongoing court case against the CFMEU.

CPB Contractors previously secured a Federal Court injunction banning CFMEU members from going within 15 metres of the entrance to Cross River Rail sites following “ongoing reports of unlawful tactics” by CFMEU representatives.

CFMEU members were also banned from photographing or recording any person or vehicle entering Cross River Rail construction sites.

On Tuesday, counsel for CPB Contractors Shannon Moody told the court they were currently in conversation with other subcontractors who may also seek to join.

The court heard CPB and UGL would be seeking damages relating to CFMEU’s alleged picketing and breaches of the Fair Work Act.

The breaches were alleged to have taken place at certain sites across a number of different days, the court was told.

Ms Moody requested a one-month adjournment to file an amended originating application after decisions were finalised regarding which parties would join.

Barrister Charles Massy, for the CFMEU, said they were awaiting a statement of claim identifying the entirety of the allegations and the damages sought.

Federal Court Justice Darryl Rangiah set the case down for a case management hearing on November 6.
