Bail for man accused of park gang rape of intoxicated woman

One of two men accused of the gang rape of a heavily intoxicated woman in a Brisbane City park on Sunday has been granted bail while his HIV positive co-accused remains in custody.

A man accused of taking part in a heinous gang rape in a Brisbane city park has been granted bail.

The man, who cannot be identified, is accused of raping an intoxicated woman with another man in the City Botanic Gardens on Sunday morning.

The 39-year-old has been charged with two counts of rape, deprivation of liberty and attempted stealing.

Police will allege the woman, 20, left a party in the early hours of Sunday morning heavily intoxicated and was later approached by the two men.

Police will allege they told the woman that they would order her an Uber.

Police allege however that they took her to the gardens and gang raped her.

During the ordeal it’s alleged they tried to steal her phone and later returned to get her banking details.

After passing out the woman left the park and was assisted by a passer by.

Police prosecutor Snr Con Min Hu said evidence against the man was allegedly strong and included CCTV and clothing seized from his home.

He said the man did not have strong ties to the community as he was not a citizen.

“The defendant has shown rampant disregard for the dignity and respect for another person,” he alleged.

His Legal Aid lawyer Megan Bowie made an application for bail which was opposed by police.

Ms Bowie said her client had no criminal history and the case was still not clear.

“There is ID evidence which is incomplete and medical evidence not available,” she said.

Ms Bowie said despite coming from a refugee background in Kenya her client had established ties to the community and was studying to be a disability support worker.

Magistrate Janice Crawford granted the man bail on the condition he not contact the co-defendant or alleged victim, abide by a 7pm to 7am curfew, report to police and surrender his passport.

The man’s co-defendant, whi is HIV positive, was refused bail yesterday.

Today’s matter was adjourned to October 11.
