Unlicensed driver Angus Ryan Oakley breaks arm fleeing roadside police in Capalaba

A Cleveland man, who broke his arm fleeing police during a roadside check, has faced court, receiving probation and a new six-month driving disqualification.

A Redland man who attempted to outrun police after being intercepted in a roadside check ended up in a plaster cast and custody, after breaking his arm and injuring his face in the failed escape.

Angus Ryan Oakley, 21, appeared via video link before Cleveland Magistrates Court on Thursday, July 3, from the Cleveland watch house.

He had a broken left arm in a cast and a visible bruise on his cheek both sustained while trying to flee Capalaba police the previous day.

A police prosecutor told Magistrate Deborah Vasta that officers had pulled over Oakley after checks revealed the car he was driving was unregistered, uninsured, and he was unlicensed.

“When we intercepted him he jumped out of the car and ran from police,” the prosecutor said.

“Police chased him and attempted to restrain him. He continued resisting, tensing up, and not complying.”

Despite breaking his arm during the incident, Oakley continued running.

“Because of the adrenaline, he was still able to run on,” the prosecutor said.

“He didn’t realise it was broken until he was in custody for a couple of hours and it started swelling up substantially.”

The prosecutor clarified that police were not responsible for the injury.

“Police did not cause the broken arm. He broke it while running from them.”

Paramedics were called and Oakley was taken from the watch house to hospital where his arm was treated and placed in a cast.

Magistrate Vasta noted Oakley’s breach of a previous probation order, which had been imposed in 2023.

The court heard that during 2024, Oakley failed to report to probation officers on several occasions, leading to the breach.

Magistrate Vasta said Oakley’s behaviour showed a repeated pattern of poor decision-making, including his attempts to flee from police.

“A lot of what you’ve been doing … is just trying to run,” she said.

The court was told Oakley had lost his job as a construction labourer earlier this year, which disrupted his routine and contributed to him disengaging from probation services.

“He found himself out of sorts,” the court heard.

Despite this, he had stayed in some contact with probation.

“You didn’t link in with some of the services they wanted you to … but you actually kept in contact with them. So that’s good,” Magistrate Vasta said.

Oakley was convicted and disqualified from driving for six months for the unlicensed offence.

For breaching probation, he was re-sentenced to a new 18-month probation order.

“You’ve got to go to counselling, attend any programs they ask you to go to, tell them if you move house or change jobs within two business days,” Magistrate Vasta ordered.

“I want you to see their psychologist … this one is free.”

She warned him not to drive again until the disqualification ends.

“If you drive between now and the third of January next year, a magistrate must disqualify you for two years.”

“You’ve been offered a golden (chance) here,” she added. “Take it.”

Oakley is eligible to reapply for his licence on January 3, 2026.
