A North Stradbroke Island father has been told by a Cleveland magistrate to drop his “revenge” fantasies after assaulting a man whose nephew allegedly raped his 15-year-old daughter.

The man pleaded guilty in Cleveland Magistrates Court on Monday, November 14, to one count of assault occasioning bodily harm and one count of threatening violence.

The court heard he was on the Island when he was involved in an argument with the victim.

“The defendant has swung multiple punches at the victim,” police prosecutor Sergeant Duncan Blackburn said.

“He (the victim) landed in a nearby garden.

“The defendant managed to get him in a headlock, pulling his hair.

“The victim attempted to grab his testicles and tried to get away.

“He wasn’t able to break free until police came.”

The court heard the victim suffered swelling and bruising to his right eye.

The Stradbroke Island man threatened the victim.

“He said, ‘I will go home and I will kill all of you c***s’,” Sergeant Blackburn said.

“I’m going to get my shotguns, you wait, you wait.”

The man’s lawyer, Brittany White, said her client and the victim had a history.

“The victim is the uncle of a nephew (allegedly) charged with raping his daughter who was 15 years old,” Ms White said.

Magistrate Deborah Vasta said the Stradbroke Island man would have to wait patiently for his daughter’s court case to come to trial.

“How is this going to look when you’re being cross-examined in front of a court,” Ms Vasta said.

“You need to grow up.

“The revenge and retribution that you are demonstrating to your kids, it’s very immature behaviour.”

He was given a probation order for two years with immediate parole eligibility.

He was ordered to pay $700 compensation to the victim and to have no contact with him for two years.

Convictions were recorded.
