A bayside father of three has faced court after grabbing his genitalia and thrusting during a showdown in front of Hungry Jack’s staff.

A bayside father, starting up a mowing company, has faced court after grabbing his genitalia and thrusting them at Hungry Jacks staff in a shopping centre and assaulting a 60-year-old security guard.

Lamb Island resident, Steven James Hall, 40, pleaded guilty in Cleveland Magistrates Court to one count of serious assault of a person over the age of 60, and one count of committing a public nuisance.

The court heard Hall was at a Hungry Jack’s at Victoria Point shopping centre on December 16 last year when a security officer was called for assistance.

“The security guard was called to assist with two males who were causing a disturbance,” the police prosecutor said.

“He told them to leave.”

The men were aggressive towards the security guard refusing to leave, the court heard.

“The defendant (Hall) said ‘I will belt security’,” the police prosecutor said.

“The security guard was forced to back off.

“They were seen laughing before he threw a punch at the security guard.”

The court heard both men were seen threatening Hungry Jack’s staff after they were refused service.

“He made inappropriate and sexual gestures towards staff,” the police prosecutor said.

“He grabs his genitalia and gestures toward them.

“Multiple people witnessed the event.”

CCTV footage was played in court showing the gestures Hall was seen making at staff.

“You can see the school kids coming in witnessing it,” the police prosecutor said.

“There were young people coming in, young people working.

“It’s appalling behaviour.”

Hall’s lawyer Alina Somerville said her client was remorseful for his actions.

“He loves working for the elderly which is why he’s deeply ashamed of his actions of this day,” Ms Somerville said.

Hall said after battling with a meth addiction he had used other means to cope.

“I’ve tried to give alcohol away,” Hall said.

Magistrate Deborah Vasta said Hall needed to learn to control his alcohol consumption.

“It was absolutely disgusting behaviour, but you were absolutely off your face at the time,” Ms Vasta said.

“It’s not a crime to drink alcohol but you need to have that tiny voice that says I’m p*ssed as a fart, and I need to shut up and go home.”

Hall was ordered to complete 60 hours of community service and to pay $250 restitution to the security guard that was assaulted.

No convictions were recorded.
