Redland Bay woman warned ‘jail on the cards’ after serial drink and drug driving

A serial drink driver lasted 24 hours before she got behind the wheel with a belly full of bourbon despite a nine-month ban.

A 40-year-old woman with qualifications in early childhood education has shown a court an “absolute, blatant disregard” of its orders by driving drunk the day after being court disqualified for nine months.

Having driven while drunk or with drugs in her system three times in the last five years, Redland Bay woman Kylie Lisa Cain, 40, was told by a magistrate “jail would have been possible” had she not “performed so well” on her probation.

Appearing at the Cleveland Magistrates Court today Cain pleaded guilty to driving while over the general but not over the middle alcohol limit while not a holder of a licence, and driving without a licence while disqualified by a court.

The court heard police observed an empty alcohol container in her vehicle when she was intercepted on Marine Street in Redland Bay at around 4.50pm on August 12 last year.

Disqualified from driving for nine months at Cleveland Magistrates Court the day before, Cain told officers she had drunk four cans of pre-mixed bourbon before driving to shops some two kilometres from her home.

Tests would confirm she had a blood-alcohol level of 0.089 per cent at the time.

A police prosecutor told the court Cain’s offending placed the community at serious risk which meant a jail term “was certainly on the cards”.

Defence solicitor Rhys Foster said his client had “removed all temptation” by selling her vehicle and was in the throes of an “incredibly emotive state” at the time of her offending.

Mr Foster said this was evidenced by the fact that Cain chose to drive to shops that were within easy walking distance, despite having drunk alcohol.

The court heard the defendant performed well on her probation, had sought counselling and had started further studies.

Magistrate Deborah Vasta denounced Cain’s “absolute, blatant disregard” of her orders and confirmed had she not been so proactive with her probation “jail would have been possible”.

Instead, the defendant was ordered to complete 70 hours of community service and disqualified from driving for two-and-a-half years.

Cain also had her probation extended to August 10, next year.
