The protracted court matter of Olympic Gold Medal winner Chantelle Newbery has been extended with a last minute submission over the alleged theft of $100 in groceries, a court has heard.

The rejection of a last minute submission from legal counsel for a former Olympian accused of stealing has seen the matter drag on yet again.

Now in its tenth month, the matter of 2004 Athens Gold Medal winner Chantelle Newbery, 44, was adjourned for a hearing review to address a dispute over the alleged theft of $100 in groceries.

According to defence solicitor Robert Burns, the former diving golden girl was able to appear at her Wynnum Magistrates Court appearance on Friday should she be called.

It is understood Newbery was in the vicinity of the court but made no appearance.

Police prosecutor Sgt Lauren Collins noted the defendant’s appearance had not been formally excused by the court.

“There is a lot of impatience here this morning,” Magistrate Zachary Sarra said.

According to court documents, Newbery stands charged with three counts of stealing; three counts of breaching bail and one count of driving while unlicensed due to SPER suspension.

The court heard Newbery pleaded guilty on March 8 to two counts of stealing but had yet to finalise the charges.

An early morning submission by Mr Burns, received by prosecutors at 7.20am Friday, was rejected after careful consideration, according to police.

“It relates to $100 in (an) unquantified number of groceries; there is no receipt,” Mr Burns said.

Describing the prosecution’s evidence as “tenuous”, Mr Burns said his client was eager to finalise the matter in order to make a “new start”.

The matter was adjourned for a hearing review at Cleveland Magistrates Court on November 10.

The court heard, should it go to trial, a February or March date was likely.
