The principal of a popular bayside real estate agency has been fined after a drink driving crash while over the limit.
Ray White Redland Bay principal Colin David Jesse James, 46, previously pleaded guilty to driving while over the general alcohol limit but under the middle alcohol limit.
Appearing at Cleveland Magistrates Court on Monday (February 7) the Redland Bay man was disqualified from driving for two months, but granted a work licence under strict conditions.
The court heard police found James at 4.59am on December 24 last year.
Tests would confirm he had a breath-alcohol concentration of 0.086 per cent.
He had no previous drink drive history within the last 25 years.
The court previously heard he had crashed and caused considerable damage to his RAM 1500 utility on Serpentine Creek Rd.
Defence solicitor Nathan Hounsell said his client had since completed the Queensland Traffic Offenders Program, which had significantly changed James’ attitude towards traffic matters and community safety.
Two character references were tendered to the court on his behalf.
Magistrate Deborah Vasta impressed on the man that he could drive exclusively for work purposes between 7am and 10pm, which would exclude even having coffee with a client.
Given his work and otherwise good traffic history, Ms Vasta spared him a conviction.
In addition to his two-month disqualification period while driving solely for work purposes, James was fined $1200.
