Out-of-control courier dragged away kicking and screaming after downing 3L of bourbon

The Zillmere man refused to go down without a fight, using his body to violently obstruct police at every turn.

A Brisbane postal courier downed three litres of bourbon and half a carton of beer before kicking out the windows of a police car and challenging an officer to a fist fight, the Sandgate Magistrates Court heard on Thursday, October 8.

Police responded to multiple calls of a disturbance in Zillmere at around 3.20am on June 27, and arrived to find Harley Stephen D’Ersby Davidson, 25, drunkenly yelling in his driveway.

Despite multiple requests and warnings, Davidson, who works full time as a postal courier, would not go back into his house and would not stop loudly shouting ‘F***!’.

Police attempted to arrest Davidson for public nuisance but taking him into custody became more difficult than they had anticipated when they placed Davidson in the back of the police car and he “violently” kicked out the window.

The court heard a more secure police car had to be called, this time a van.

Davidson was put in the enclosure in the van, but then began to aggressively hit his head against the side of the vehicle, causing police to fear for his safety.

When an officer went to check on him, Davidson took the opportunity to push the officer back and try to escape the enclosure.

A scuffle ensued, in which Davidson tried to use his legs to move the officer away and gain freedom, but he was ultimately unsuccessful.

The police prosecutor told the court Davidson resumed throwing his head against the car, forcing the officers to once again open the van door.

This time when Davidson attempted to escape he challenged an officer to a fist fight, demanding they fight in the street.

It took all three officers forcefully pushing Davidson back into the van, as he stuck his leg between the van door and the footwell, to get him back into the enclosure and transport him to the watch house.

The lawyer for the defence told the court Davidson had significant issues with alcoholism which he was taking steps to curb.

Davidson was found guilty of all four charges, a conviction was recorded and he was sentenced to probation for 12 months.
