Man who raped teen boy five times at Taigum will die in jail: Court

A Brisbane man who raped a 16-year-old boy five times a decade ago has been sentenced to nine years’ imprisonment, a term which will see the offender die behind bars due to his terminal oesophageal cancer.
The Everton Park man, aged 52, was found guilty at trial of five counts of rape and one count of sexual assault and was sentenced on Wednesday in the Brisbane District Court.
He was also sentenced for a string of drug offences he pleaded guilty to, including multiple counts of supplying methamphetamine.
The court heard the sexual offences occurred over a 12-month period sometime between October 2010 – September 2012 at the man’s former residence at Taigum.
The six offences were committed during three separate attacks on the boy.
The first occurred when the man began arguing with the boy in the presence of others during a party.
He threw his drink at the victim before several of those present at the party held the boy down while the man removed his pants.
He positioned himself behind the boy and told him it would be “okay” and that he would “enjoy” the assault, the court heard, before Brewer anally raped the boy, who felt pain and “disgust”.
During the second assault, the man attacked the boy in the shower, anally raping him and leaving him “crying”.
The final assault consisted of the man attacking the boy while he was playing a video game, attempting to “touch and kiss him” before wrestling the victim onto a bed, rubbing oil all over his body, including his testicles (the charge of sexual assault) and then raping him with a finger, his penis and a vibrator.
The court heard the man, who had a “good work history” and a partner of 30 years, who was supporting him in court, had a life expectancy of 6–12 months after a diagnosis of terminal oesophageal cancer.
Judge Jennifer Rosengren reduced his sentence from a range of 11–12 years to nine years in light of his prognosis.
She further declined to issue a serious violent offender certificate (meaning the man would have to serve 80 per cent of his sentence before eligible for parole) in order to set his parole eligibility after he had served four years.
Judge Rosengren acknowledged that, despite the discount, the sentence would almost inevitably see him die in jail.
The man, whose eyes fluttered open and shut throughout the sentence and who swayed like a sapling in the breeze when asked to stand, was led away with a bag full of medicine for transport to the Princess Alexandra Hospital Secure Unit at the conclusion of the sentence.
