A court north of Brisbane has heard how a father-of-four chased down and overpowered his pregnant partner outside a Moreton Bay shopping centre.
Samuel Raymond Smith, 27, from Morayfield, faced Caboolture Magistrate Court via video link on October 4, charged with common assault in a public place while adversely affected by intoxicating substance.
The court heard that about 5.30pm on August 14, 2022, police were called to IGA Caboolture, where they found four children and a woman crying in a car.
The court heard CCTV footage from outside the IGA showed Smith launching a violent tirade on the woman.
Police prosecutor Senior Constable Miles said CCTV showed disturbing footage of Smith hunting down the woman in the carpark.
The footage showed the woman trying to make a phonecall while holding her hands up to defend herself but Smith lunged at her, violently snatching at the phone, forcing it to fall to the ground.
Ms Miles said the footage then showed Smith screaming within inches of the woman’s face as she tried to move away, before appearing to spit in her face and throwing a punch that narrowly missed her.
“A short time later the defendant marched back towards her before standing over the top of her screaming,” Senior Constable Miles said.
“The aggrieved is seen attempting to get away from Smith however he grabbed her around the shirt, before grabbing her around the neck with his forearm in a headlock position.
“She attempted to escape from the defendant’s control but he grabbed her by the hair and shirt, causing her to fall to the ground.
“The defendant again approaches the aggrieved, punching her in the left thigh area with a closed fist.
“The aggrieved is then observed on the ground, emotionally upset, crying and shaking.”
At 7.10pm the same day, police were called to a Bribie Island home where Smith’s partner told them about the earlier attack.
A short time later Smith arrived in a taxi and was unable to recall the attack in its entirety, stating to police he drank 750ml of home brewed whiskey with his father that day.
Smith’s lawyer Ms D’Souza said Smith was exposed to violent household at a young age, attending school until Year 11 on Bribie Island.
Ms D’Souza told the court Smith has four children with the victim with another child on the way.
Magistrate James Blanch said it was a disgusting attack.
“He carried on like an animal,” Mr Blanch said.
“No one needs to be treated the way she was on that day.
“She is pregnant to you again, unbelievable.”
Smith was sentenced to seven months imprisonment with immediate parole.
Convictions were recorded.
