Magistrate praises man who restrained armed intruder after violent scuffle
A Magistrate has praised the efforts of a man who put himself in harm’s way to protect a woman from an intruder armed with a pipe.

A Redcliffe man was lucky to escape a prison sentence today after appearing in court in relation to an assault.
Ashley Stuart Russ, 52, appeared in Redcliffe Magistrates Court today and pleaded guilty to two counts of breaching a police protection order and unlawful assault.
The court heard Russ attended the address at Oxley Ave on April 11, despite being banned from being there by police after an incident the night before.

Russ arrived at the house armed with a PVC pipe, alerting home’s dogs.
The victim came downstairs and Russ struck him with the pipe.
The victim, in self-defence, tackled him to the ground.
The scuffle continue, with both men throwing punches until a woman grabbed the pipe and used it to break them apart.
Russ was restrained by the victim on the outdoor stairs.
Police were called and Russ was taken to hospital by Queensland paramedics.
Duty lawyer Lee Jeffries handed up a photo showing the injuries Russ sustained.
Magistrate Mark Bucknall said the injuries were as a result of him choosing to go to the home.
“If he came off second best in that confrontation then so be it,” Magistrate Bucknall said.
He added that the victim had done the other people living at the home a favour by restraining Russ.
The court also heard Russ had issues with alcohol use and was seeking treatment.
Magistrate Bucknall sentenced him to a 12-month probation order.
