Jay Desmond Bucholz: Ferny Hills man faces court after motorcycle accident

A Ferny Hills man who attended the “school of Hard Knox” has faced the music after a motorcycle accident north of Brisbane.

A self proclaimed “fulltime f***ing legend” who attended “the school of Hard Knox”, according to his social media, has faced court after his involvement in an accident, north of Brisbane.

Jay Desmond Bucholz, 39, appeared before the Pine Rivers Magistrates Court on Monday facing a string of charges including driving without due care and attention and fail to provide specimen as required for a breath test.

The Ferny Hills man pleaded guilty to six charges in total from two separate offences, including one relating to a traffic accident at Dayboro.

The court heard Bucholz was riding a motorcycle on Mount Sampson Rd on June 20 when he was involved in an accident.

Police prosecutor Sergeant Graham Turner said officers attended the accident at around 2.45pm.

Sgt Turner said witness information given to police stated that the motorcyclist had stuck the back of another vehicle while attempting to overtake.

“He has overtaken one car, gone to overtake a second and clipped the back of the vehicle … causing loss of control,” Sgt Turner told the court.

“The driver of that vehicle had to take evasive action, seeing the way that the motorcycle was being driven.

“In that occasion, (Bucholz) suffered abrasions on numerous locations on his body.”

The Queensland Ambulance Service attended however further treatment was declined.

The court heard Bucholz admitted to police he had consumed liquor at the Dayboro Hotel just prior to riding.

He could not specify how much he consumed with Bucholz subsequently refusing to supply a sample to officers.

Bucholz was then spotted just a month later at Arana Hills driving another vehicle, when he again refused to supply a specimen for testing.

Bucholz addressed the court saying he was “apologetic” for his actions.

“I was never hostile to those police officers, I was apologetic,” he told the court.

“I had just crashed my father’s motorbike, it was his pride and joy.

“There was a lot to take in (and) I knew I made a mistake.”

The 39-year-old told Magistrate Annette Hennessy he had made progress since the incidents.

“I don’t want to be before the court, I don’t want to waste the court’s time,” he said.

“I believe I’ve come a long way in a short time.

“For the case of the second charges where I was at Arana Hills – I was going stir crazy from being at home during my injuries.

“I took myself to work and was on my way home from work at the time, I thought I was trying to do the right thing.”

The Ferny Hills man vowed to never appear before the court again.

Ms Hennessy took into account Bucholz’s personal circumstances and his early plea of guilty.

Bucholz was convicted and fined $2200 and disqualified from holding a licence for six months.

“If you do drive while disqualified then the next minimum period is two years,” Ms Hennessy warned.

“Just make sure you are not driving before you receive a driver’s licence.”
