‘I’ll set this house on fire, you better run!’: Ocean View man sentenced to prison

An Ocean View man who threw furniture at his wife’s head and threatened to burn their house down was sentenced to prison at the Pine Rivers Magistrates Court on Thursday.

Filmed footage tendered to police showed 51-year-old Jason Dean Hamilton screaming at his wife of six years as she packed her bags.

“You better run, I’ll set this house on fire, you better run!” Hamilton said.

“I’ll f*****g knock your head off!”

Police prosecutor sergeant Selena Hobill told the court police were first called to the couple’s home at 8am on December 30, 2019 to investigate reports of domestic violence.

The woman told police she’d had a violent argument with her husband during which time he’d thrown a drawer at the back of her head, painfully injuring her.

Hamilton was subsequently subject to a domestic violence order which prohibited him from staying at the home without the written consent of his wife.

Police were called to the home again on September 1, 2020, when the wife withdrew consent during a particularly violent argument.

The woman filmed the man as he became angrier and angrier, refusing to leave, screaming “nasty names” at her, and threatening to set fire to their home.

The man was arrested but failed to appear in court.

Defence lawyer Brendan Beavon told the court the couple were seeking counselling and trying to reconcile their marriage despite the repeated violence.

“He feels ashamed of what has occurred,” Mr Beavon said.

“It was an argument that got out of hand.”

Hamilton pleaded guilty to contravention of a domestic violence order, failure to appear in accordance with undertaking and assault occasioning bodily harm.

Magistrate Trevor Morgan said Hamilton “made a serious threat to terrify (his) partner” and sentenced him to three months in prison, immediately suspended for an operational period of 18 months.
