A heavily intoxicated 18-year-old McDonald’s worker punched a police officer in the head, arms and chest during a family altercation at the Strathpine train station, the Pine Rivers Magistrates Court heard on Thursday.

According to police prosecutor sergeant Graham Turner, it was 4.20am on Christmas Eve and Maliq Leroy Jackson had a blood alcohol concentration of .160, more than three times over the legal limit for driving, when he became aggressive towards police.

Officers were on scene to attend to another disturbance when they saw Jackson throw a glass bottle at the concrete pathway, causing it to shatter and create a safety hazard for commuters.

Jackson grew increasingly agitated as officers spoke with his uncle, yelling and swearing at the older man in an attempt to coax him into a fist fight.

The court heard Jackson’s family rushed to hold him back as he shouted abuse at his uncle, calling him a “c--t”.

Police were forced to intervene and physically restrain Jackson, who didn’t go down without a fight.

No conviction recorded for Maliq Jackson.

Jackson pushed and punched the officer in the head, arm and chest before he was finally arrested.

Defence lawyer Andrew Ferrett of the Aboriginal and Torres Strait Islander Legal Service told the court there had been a “family incident” in which Jackson had become enraged at his uncle and “got involved in the fracas”.

Mr Ferrett said the young man, who is casually employed at a local McDonald’s, was new to drinking and couldn’t handle his alcohol.

“He is very remorseful,” he said.

Jackson pleaded guilty to assaulting a police officer in a public place while adversely affected, public nuisance and dangerous littering.

Magistrate Trevor Morgan sentenced Jackson to 50 hours of community service to be completed over 12 months and fined him $300.

No convictions were recorded.
