Woman, 27, on bail after allegedly assaulting her elderly mother on multiple occasions

A 27-year-old woman who allegedly knocked her elderly mother out of a wheelchair, has been let out on bail despite police objections.

A 27-year-old woman who allegedly pushed her elderly mother out of a wheelchair has been let out on bail after spending 25 days in jail.

The woman, who cannot be named for legal reasons, appeared via video link in Redcliffe Magistrates Court on May 20, to make an application for bail.

She is charged with a number of offences including three breaches of domestic violence orders and failure to appear.

The defendant's solicitor Mr Littlejohn made a case that the “root cause” of the alleged offending was that the defendant was homeless.

Police Prosecutor Sergeant Tim Clare disputed this.

“There are four offences before the court and three of them have allegations of violence,” Sgt Clare said.

“Two of which are fairly concerning.

“The first one was that the mother was knocked out of a wheelchair and two holes punched in the wall.

“Two days later there was an allegation the defendant was at the aggrieved’s address and the aggrieved could be heard yelling ‘leave me alone, please stop beating me’.

“On April 26, two days latter, she was at the address at 6.20am and there was again an allegation of violence on that day where disturbances occurred between both parties.”

Sgt Clare said the defendant allegedly left the home before police arrived. She was later located and arrested.

The defendant is then alleged to have returned to the address, 15 minutes after being released on bail.

“There was no violence on that occasion, it was just her presence at the address,” Sgt Clare said.

Sgt Clare said the prosecution’s main concern was the frequency of offending.

Magistrate Bucknall said the issue was, due to the COVID-19 situation, that the defendant could end up spending more time in custody than what she might be sentenced to, if found guilty.

The defendant, also a mother, has already spent 25 days in jail.

He imposed strict bail conditions. Ordering the defendant to reside at her boyfriend’s parent’s house in the Moreton Bay region. A curfew was also imposed.

She was ordered to wear a tracking device and not to go within 200m of the aggrieved’s address.

She was also forbidden from contacting or approaching her elderly mother.

Magistrate Bucknall warned that if she were to breach the conditions she would end up back before the courts.

“I warn you, if you don’t comply with these bail conditions, I can almost guarantee you, that you will be straight back where you are now,” Magistrate Bucknall said.

The defendant responded: “Yes sir, I don’t like it here, I won’t commit any more crime”.

The matter was adjourned until June 4.
