A woman has had a victory in court after pleading for mercy on a drink driving sentence, busted four times the legal limit after swerving on the road.

A Logan woman who copped a 14-month driving disqualification after she blew four times the legal limit has had her sentence reduced by a Logan court.
On November 7, 2022, Monica Stipancic, 28, was fined $1800 and disqualified from driving for 14 months in a Logan court after she was busted drink driving on October 21, 2022.
Ms Stipancic appealed the original decision in Beenleigh District Court on June 23, 2023, asking to have both the fine and disqualification period reduced.
The court heard police saw Ms Stipancic in October driving at a low speed and swerving between two lanes of traffic in Springwood.
The officers pulled her over for a breath test, where she recorded a blood alcohol concentration reading of 0.2 per cent — four times the legal limit.
Judge Craig Chowdhury considered both the woman’s traffic and criminal history.
“The criminal history, as the magistrate said, had no relevance on the sentence,” Judge Chowdhury said.
“The traffic history certainly contains previous convictions for exceeding the speed limit and failing to display allegedly green (P) plates.
“But it certainly wasn’t a bad traffic history.”
Ms Stipancic‘s lawyer said during the appeal that the sentence was excessive for the charges.
The police submitted the fine and disqualification period imposed was accurate given the extent of Stipancic’s drunk driving.
However, Judge Chowdhury agreed the original driving disqualification was extensive, but the $1800 fine was appropriate for Ms Stipancic’s offence.
“It was observed that the reading of 0.2 was four times the legal limit,” Judge Chowdhury said.
Ms Stipancic was given a reduced driving disqualification to 12 months instead of the original 14 months.
