A 38-year-old Holmview man who drunkenly flipped his car at a Gold Coast petrol station has been sentenced to jail.

Australia's Court System

A man who drunkenly crashed his car into a give way sign and flipped it at a petrol station in Stapylton, appeared at Beenleigh Magistrates Court.

The court heard on August 29 last year, Luke Rosenkranz, 38, drove his car deliberately loudly and crashed into a give way sign at a BP petrol station in Stapylton.

Rosenkranz was driving at high speed and hit the left side kerb before the exit ramp which put his car on two wheels.

The car bounced from the left kerb, drove over the island and crashed into a give way sign.

The defendant fled from the scene, he told the court he “freaked out” and regretted his decision to leave the petrol station.

Rosenkranz was found to be illegally over the blood alcohol limit and registered a 0.08 per cent reading.

Rosenkranz, from Holmview, pleaded guilty to dangerous driving, being over the alcohol limit and driving deliberately loudly and causing smoke.

He pleaded guilty to not complying with police when they attended the incident.

The defendant was also caught with cannabis and a smoking implement, when police arrested him at his home.

Rosenkranz said he had been self-medicating with cannabis for a long time and was currently prescribed legal, medicinal cannabis.

Magistrate Michael O’Driscoll said Rosenkranz’ driving was reckless and dangerous to himself and others.

“You put your life and the lives of people at the service station at risk,” he said.

“I’m concerned about your conduct, your dangerous operation of a vehicle is in my view, a very serious matter.

“Quite simply, you should not have been on the road, in light of your alcohol content on that particular occasion.

“In regard to the charge of driving to deliberately cause noise or create smoke, that is simply ridiculous conduct, drawing attention to yourself.”

The defendant was sentenced to a six month suspended prison sentence and his driver’s license was disqualified for one year.
