A Logan man who drunkenly punched wildly at a police officer has told a court he is filled with regret.

Luke Christopher Wharton-Cameron pleaded guilty in Beenleigh District Court on July 19 to one count of serious assault of a police officer causing bodily harm,

The court heard that on October 22, 2020 in Marsden, police were attending to a disturbance involving Wharton-Cameron.

When police arrived, the 23-year-old was heavily intoxicated and belligerent with the officers.

Crown prosecutor Nardine Wardell said the attack involved several, wild fish swings at a police officer as he attempted to restrain Wharton-Cameron.

He was then tased as police struggled to control the heavily intoxicated Wharton-Cameron.

“The victim was Senior Constable Ian Smith. He approached the defendant’s house responding to a disturbance,” Ms Wardell said.

“He grabbed Wharton-Cameron’s left forearm and he swung around, punching him in the head with his right fist.”

A victim impact statement was tendered to the court as well as photos of the police officer’s injuries that he sustained from the attack.

“He has complied with the administration of justice. He was too intoxicated at the time of the offence to be interviewed but did apologise to the victim,” Ms Wardell said.

“The victim impact statement outlines the negative emotional and physical impact the assault had on him.”

The court heard Wharton-Cameron graduated from Balmoral State High School and achieved various work certificates while casually employed as a labourer.

Defence barrister Jack Kennedy said the behaviour was a drunken lapse and completely out of character.

“In my submission what occurred here was an aberration of his character and a first time offence,” he said.

“My client said he was sorry a bunch of times and said he felt like a piece of s--t for what he had done.

“He read the victim impact statement earlier today and began crying.

“He stated ‘I didn’t realise what an impact it had on him’.”

Judge Katarina Prslako accepted the offending was not a representation of the defendant’s normal behaviour.

“I accept this offence is out of character for you and you have no violent criminal history,” she said.

“I’m dealing with a relatively youthful first offender and I think an 18-month prison sentence is too high.”

Wharton-Cameron was sentenced to 12 months prison, wholly suspended for 18 months.

He was also ordered to pay $2000 in restitution to the victim.
