A Logan man has been charged with rape, choking, sexual assault.

A Logan man has been refused bail for a second time after his alleged despicable acts on a woman that included repeated rape, once while she neared unconsciousness, choking and him forcing her to drink his urine.

The 33-year-old was charged with two counts of choking suffocation strangulation domestic relationship - domestic violence offence, three counts of rape domestic violence offence, one charge of contravention of domestic violence order and a sexual assault charge.

The court heard the man had no criminal record.

Police prosecutor Sergeant Stephen Cochrane said the man’s first bail application was refused in November, 2023 after his arrest in November 15 that year.

Sgt Cochrane said there was no risk of the man spending too much time in custody for his charges.

“If convicted he would be spending the better part of the next decade in custody … He has spent 147 days in custody since his arrest for this seriously violent offending,” he said.

Sgt Cochrane told the court the man raped, strangled and sexually abused a woman for several hours in August, 2023.

“He forced her to drink a cup of his urine and after that he vaginally and anally raped her,” Sgt Cochrane said.

“This prolonged over many hours before he strangled her until unconscious and raped her again.

Sgt Cochrane emphasised the seriously “abhorrent” nature of the man’s alleged crimes.

The court heard that medical examinations of the victim revealed red spots in her cervix, raised blood vessels in her neck potentially caused by the man’s alleged choking and bruising.

Magistrate Patrina Clohessy confirmed there was medical evidence consistent with allegations of choking.

Lawyer Hannah Wallace said police had fallen three months behind in providing her office with a full brief of evidence.

“I have only received a partial brief of evidence from police and have not yet received a response,” Miss Wallace said.

“This change of circumstance is sufficient to reconsider the decision of bail.

“He is undergoing the Gunya Meta program for community and has his family present in court supporting him.

“He has lost 20kg while in prison and is prioritising his health,” she said.

Magistrate Clohessy said the offences to which he is charged were very serious.

“Putting his hands around her neck and choking her to the extent to which she saw white dots in her eyes and further sexually assaulting her is conduct that was allegedly reasonably prolonged,” Ms Clohessy said.

“If he is convicted of those offences there is no doubt he will receive a lengthy period of custody and the time he has spent in custody while significant, does not yet place him in jeopardy or risk of serving too much time.’’

Ms Clohessy was not satisfied the man had shown cause to be released on bail.

“He is an unacceptable risk of interfering with witnesses,” she said.

The man was denied bail and his matter was adjourned for mention on May 8.
