A Bayside woman charged with two counts of attempted murder, along with three other co-accused, for an alleged drive-by shooting in Waterford last year, has applied for bail.
Bayside woman Lacey Natika Christine Brookes, 24, faced Beenleigh Magistrates Court on April 11 charged with two counts of attempted murder.
The court heard one of the co-accused, Karlie Mahoney, was granted bail on February 16.
Ms Brooke's defence lawyer Bruce Affleck said she had been remanded in custody since her arrest in August last year.
“She has done work with the sister’s group while in custody,” he said.
“There is undoubtedly a strong prosecution case, but whether there is a strong argument for an attempted murder charge is questionable.”
The court heard two men were allegedly shot out of a car by four people on Carnarvon Cres about 2am on June 16, 2023.
One man was shot in the left side of the face and the other received a bullet wound to his left arm.
The back window of the car was shattered, with glass sprayed through the vehicle.
The two men were taken to Princess Alexandra Hospital.
Magistrate Patrina Clohessy said Ms Brookes had applied for bail in August and September last year and she could not see a situation where it could be granted.
“There appears to be a reasonably strong prosecution case to tie Ms Brookes to the alleged offences,” she said.
“There’s no difference in the change of circumstances between the supreme court bail application and this one.
“I do not consider there is a material change. There have been two previous bail applications which were refused and there shouldn’t be any issues with the matters progressing through the courts.”
Bail was refused and the matter was adjourned to April 24, the same date as the three co-accused.
Ms Brookes remains remanded in custody and her appearance will be excused for the next mention.
