A Logan man who allegedly assaulted his partner has told a court he “accidentally” headbutted her after a fight over their child’s diet.

Jeremy Mervyn Dooley Caitlin, 25, faced Beenleigh Magistrates Court on June 4 charged with one count of assault occasioning bodily harm.

Police alleged that on July 30 in Loganlea, Mr Dooley Caitlin was at home with his girlfriend when an argument broke out.

He then allegedly pushed her into a door, grabbed her and headbutted her in the face.

The court heard she was taken to hospital with a non-displaced nasal fracture.

Defence lawyer David Gilmore said his client pleaded guilty to the charge, but only on the basis that he had accidentally headbutted her.

“The basis of the plea was that the assault was not intentional but caused by recklessness,” he said.

“Mr Dooley Caitlin moved his head backwards to threaten the victim, then moved it forward.

“He got it wrong and made contact, which wasn’t his intention and now he bears the consequences.”

Magistrate Shane Elliott said the sentence would need to be adjourned as this piece of information would be crucial in determining the outcome for Mr Dooley Caitlin.

“This would make a difference to the penalty, if an adjournment needs to be had for those inquiries to be satisfied, I have no problem with that,” Mr Elliott said.

The court heard Mr Dooley Caitlin had no criminal history.

The matter was adjourned to July 2 for mention and his bail was enlarged.
