Jayden Fone pleads guilty to drug-driving without a license

A young driver has lost his licence and been stung with a heavy fine after a court heard he was caught drug driving twice in one day.

A suspended driver who hit the road three days after smoking ‘four-five cones’ was already in enough trouble after being pulled over and saliva tested at Cedar Grove on the morning of June 13.

The Beaudesert Magistrates Court heard the young man then made the mistake of running the gauntlet later that day, driving again just a short distance from where he was pulled over the first time.

Jayden Fone, 22, from Glenlogan, pleaded guilty to two counts of drug-driving, and two counts of driving without a license.

The court heard on June 13 at 10.12am Fone was driving on Cedar Grove Rd, Cedar Grove, when he was intercepted by police for a roadside breath-test and drug-test.

Police prosecutor Senior Constable Andrew Bjerring told the court a check revealed Fone’s license had been suspended from May 20, 2021 to November 19, 2021.

“During the roadside drug-test he returned a positive sample for cannabis,” Sen Const. Bjerring said.

“He (Fone) said he had smoked between four to five cones of cannabis three days ago.”

The court heard at 12.20pm on the same day he was again pulled over by police, driving the same vehicle, on Cusack Lane at Jimboomba – about 7km away from the first incident.

Fone again provided a sample of saliva, and cannabis was found in his system.

“Police established the offender had been placed on a 24-hour driver license suspension, and said Fone offered up no reason for driving on the second occasion,” Sen Const. Bjerring said.

When asked by Magistrate Tracy Mossop what he had to say for himself, Fone replied, ‘ah not much’.

“It’s my stupidity smoking and driving so yeah,” he said.

Ms Mossop agreed with him.

“Certainly was. And you were four times over it seems, with four offences,” she said.

“Because of the choices you made that day you are now going to be the subject of significant fines.

“Whatever is going on with you, well, I hope you address those issues.

“Just stay away from drugs.”

Ms Mossop issued fines of $300 for each of the drug driving offences, and fined Fone another $300 for driving without a license.

The total was $900, with a two-and-half year license disqualification.

“From today your traffic history is going to show a two-and-half-year license disqualification.

“You can apply after two years to get your license back.”

Convictions were recorded for driving without a license, but not for the drug offences.
