Domenic Caporale: No bail for Logan man accused of assaulting disabled victim in armed robbery

A 37 year old man is accused of assaulting and threatening a learning disabled person in Loganholme with a toy gun.

A 37 year old man from Loganholme who allegedly brandished a replica firearm and assaulted a disabled person with it in March has been denied bail in Beenleigh Magistrates Court.

Domenic Caporale is accused of assaulting a victim with a learning disability in Loganholme and refused to hand over his mobile phone to police.

It is alleged the victim was struck in the face several times before being threatened with the firearm.

The replica gun was found in the defendant’s brother’s bedroom by police.

Prosecutor Sergeant Donna Kay said the defendant refused to comply with police by not handing over his phone and was a risk to the victim.

“There is significant evidence likely to be located on the phone,” said Sgt Kay.

“He is an extreme risk to the victim.”

Defence lawyer Thomas Allen said the item used was not a weapon.

“Police found essentially a toy, it can be bought at retail stores,” said Mr Allen.

Mr Allen also said the evidence on the phone was circumstantial and there was no way of proving his defendant had sent incriminating messages.

Magistrate Michael O’Driscoll looked at images of the weapon used and said the gel blaster item in the robbery was “not a toy.”

Caporale previously lived in Melbourne and in Victoria in 2020, was convicted of using a firearm in a public place.

Bail was refused and the matter was adjourned to Beenleigh Magistrates Court for mention on September 3.
